The ecommerce counterfeiting problem

eBay's Verified Rights Owner Programme (VeRO) allows trademark and copyright holders to report listings that infringe on their intellectual property. Once accepted into the programme, you can submit takedown requests that are typically processed within 24 hours.

To join VeRO, you need to complete eBay's application form and provide evidence of your intellectual property rights. Again, a registered trademark makes this process much simpler.

Etsy IP protection

Etsy has an intellectual property reporting system that allows brand owners to report listings that use their trademark, copy their product photos, or reproduce their copyrighted designs. Reports are typically reviewed within a few business days.

For Etsy sellers, the challenge is often distinguishing between legitimate competitors making similar products and genuine copycats who are copying your exact designs and branding.

General marketplace strategies

  • Register your trademark first. Every major marketplace's brand protection programme requires or strongly favours registered trademarks.
  • Document your products thoroughly. Keep records of original product photos, design files, and creation dates. This proves ownership if a dispute arises.
  • Monitor regularly. Search for your brand name and product names on each marketplace at least weekly.
  • Report quickly. The longer a counterfeit listing is active, the more damage it does. Report infringements as soon as you find them.
  • Use watermarks and branding. Make it harder for copycats to reuse your product images by including subtle branding.
